General provisions
1. Scope and acceptance
All customers ordering, accessing, or using products and services provided by Cyberlocker Switzerland S.A. (“Cyberlocker,” “SwissHosting,” “we,” “us,” or “our”) must comply with this Acceptable Use Policy (“AUP”) and the applicable Master Service Agreement, Terms of Service, service order, and related policies.
This AUP applies to customers, authorized users, administrators, employees, contractors, end users, and any other person who accesses a service through a customer account.
We may update this AUP from time to time. Material changes will be published on the SwissHosting website. Continued use after an updated policy takes effect constitutes acceptance of the revised AUP to the extent permitted by applicable law.
2. Customer responsibility
Customers are responsible for all activity originating from their accounts, servers, virtual machines, IP addresses, credentials, applications, and assigned network resources, whether the activity is performed by the customer or by an authorized or unauthorized third party.
Maintain secure passwords, keys, software, operating systems, and access controls.
Apply security updates and remediate known vulnerabilities within a reasonable period.
Monitor services for compromise, abuse, excessive resource use, and unauthorized access.
Ensure that users, customers, and downstream clients comply with this AUP.
Cooperate promptly with reasonable security, abuse, and incident-response requests.
3. Prohibited content and activities
Customers may not use SwissHosting services to create, host, store, transmit, facilitate, promote, or conceal unlawful or abusive activity. Prohibited use includes, without limitation:
Illegal activity
Any activity or material that violates applicable Swiss law, a binding court order, or another law that validly applies to the customer or service.
Malware and harmful code
Developing, distributing, controlling, or knowingly hosting viruses, worms, trojans, ransomware, botnets, credential stealers, exploit kits, or comparable malicious code.
Fraud and deception
Phishing, identity theft, financial fraud, impersonation, deceptive order information, payment-card abuse, chargeback manipulation, or interference with billing and usage measurement.
Unauthorized intellectual property use
Knowingly storing or distributing software, media, trademarks, trade secrets, patented material, or other content without the rights or authorization required by applicable law.
Unlicensed software
Installing, distributing, or operating software without a valid license or other lawful authorization.
Threats and exploitation
Credible threats of violence, unlawful harassment, sexual exploitation of minors, trafficking, or other content whose possession or distribution is unlawful.
Abuse of third parties
Using the service to stalk, harass, extort, intimidate, dox, or unlawfully expose confidential or personal information.
Resource and platform abuse
Activity designed to evade service limits, exhaust shared resources, conceal abusive workloads, or materially degrade infrastructure used by other customers.
4. Security, access, and network abuse
Customers may not use the services to interfere with, damage, probe, or obtain unauthorized access to networks, systems, services, accounts, or data.
Denial-of-service or distributed denial-of-service attacks.
Packet spoofing, source-address forgery, routing manipulation, or falsified protocol information.
Port scanning, vulnerability scanning, penetration testing, or security research without clear authorization from the system owner.
Credential attacks, brute-force attempts, password spraying, or circumvention of authentication controls.
Unauthorized interception, monitoring, collection, or recording of network traffic or communications.
Operating open proxies, relays, resolvers, or other services that are intentionally or negligently configured for third-party abuse.
Scripts, commands, or software intended to disrupt another user’s server, session, terminal, application, or service.
5. Email, messaging, and unsolicited communications
Customers may not use SwissHosting services to send, enable, or support unsolicited bulk communications or deceptive messaging practices.
Unsolicited bulk email, junk mail, or commercial messages sent without required consent.
Forged, misleading, or concealed sender information, headers, domains, or reply paths.
Email harvesting, purchased recipient lists without lawful permission, or automated account creation for messaging abuse.
Promotion, sale, or operation of spamware, phishing kits, bulk-mailing abuse tools, or services primarily intended to evade anti-abuse controls.
Chain letters, pyramid schemes, fraudulent promotions, or repetitive messages intended to harass recipients.
Transactional and requested communications must still comply with applicable consent, identification, opt-out, and data-protection requirements.
6. Investigations and enforcement
SwissHosting may investigate suspected violations using information reasonably available to us, including network telemetry, abuse reports, service metadata, customer communications, and information supplied by affected parties or competent authorities.
Depending on the severity, urgency, recurrence, and impact of an incident, we may take one or more of the following actions:
Request information, remediation, or confirmation from the customer.
Temporarily filter traffic, block ports, null-route an address, isolate a system, or restrict a service.
Suspend or terminate affected services or accounts.
Preserve relevant records where required or reasonably necessary.
Report suspected criminal activity or respond to valid legal process as required by applicable law.
Charge reasonable remediation, investigation, or recovery costs where permitted by the applicable agreement.
We may act without prior notice when immediate action is reasonably necessary to protect networks, customers, third parties, or the public; to contain active abuse; or to comply with a binding legal obligation. When practical and lawful, we will provide notice and an opportunity to remediate.
7. Reporting abuse
Reports should identify the affected IP address or hostname, relevant timestamps and time zone, a clear description of the activity, supporting logs or headers, and reliable contact information for the reporter.
Replace the placeholder abuse address below with the monitored address used by SwissHosting before publication.
No waiver
A delay or failure to enforce this AUP does not waive SwissHosting’s right to enforce the same or another provision later.
Severability
If any provision is found invalid or unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law.
Conflicts
If this AUP conflicts with a signed service agreement, the signed agreement controls only to the extent of the conflict. The remaining portions of this AUP continue to apply.
Governing documents
This AUP should be read together with the Términos de Servicio, Política de privacidad, and any applicable service order or Master Service Agreement.
